·         Billing and financial information (Please be reminded that the use of any merchant service provider and/or third party platforms for the payment of the Admission Fee is subject to the privacy policy of the relevant merchant service providers and/or third party platforms)

·         Other data that you voluntarily provide (e.g. data to identify a lost account)

2. Data collected automatically

When you access our Website or use the Services, we may use cookies  and/or other similar technologies. Cookies are small text files stored by browser(s) on your desktop computer or mobile device. When you access the Services through any third party services such as social networking sites (e.g. Facebook, WeChat, Google) or from any mobile devices, you allow us access to certain information stored on these third party services or mobile devices such as:

4. To secure the Services

Ensuring the security in the course of performing the Services is a top priority for us. We take appropriate security and technical measures to protect your information from unauthorized access, loss and misuse. To achieve this purpose, we also request our suppliers who process personal information on our behalf to take appropriate security measures.

In order to keep the Service and its social features safe and fair, to fight fraud and to ensure acceptable use otherwise, we have a legitimate interest to process necessary data to

·         Prevent cheating, crime or fraud

1. Our personnel, related or affiliated companies

We require that these parties agree to process such information in compliance with our Privacy Policy contained herein, and we will use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

2. Other users

As social features are a core element of our games, other users may see your profile data, in-game activities and read the messages you have posted.

Any user who receives any information including personally identifiable information, from another user shall not disclose or use such information, save where expressly permitted by that user or save where such information has ceased to be of a confidential nature. In any event, we shall not be liable for any unauthorized disclosure or use by another user or other person of any content.

3. Partners working for us

We have partners (including but not limited to advertising, marketing and social media partners) to perform services for us. These partners may access your data and operate under their own privacy policies. We encourage you to check their privacy policies to learn more about their data processing practices.

4. Other companies and public authorities

We may release personally identifiable information and/or non-personally-identifiable information to, exchange such information with companies and organizations or provide such information to public authorities if required to do so by law, or in the good faith belief that such action is necessary to comply with all and any applicable laws, or where it is pursuant to we are required to respond to a governmental, regulatory, administrative or court order or directive, a subpoena or a search warrant, or to combat fraud and illegal activity.

We also reserve the right to disclose personally identifiable information and/or non-personally-identifiable information that we believe, in good faith, is appropriate or necessary to enforce the Agreement, take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government authorities and enforcement agencies, to protect the security or integrity of the Services, and to protect the rights, property, or personal safety of ourselves, our users or others.

IV. THE OPTIONS YOU HAVE ABOUT YOUR PERSONAL DATA

1. Opt out of advertising and/or marketing materials

You may opt out of receiving advertising and/or marketing communications by following the instructions in such communications or by using options provided in the game settings.

2. Access and correct the personal data we hold about you

You have the right to access and correct your personal data.

3. Other rights

You also have the right to have your personal data deleted, object how we use or share your personal data, and restrict how we use or share your personal data. You can always withdraw your consent.

If you have questions about data protection, or any requests for resolving issues with your personal data, we encourage you to primarily contact us through the game so we can reply to you more quickly. We will respond to all requests within a reasonable time frame.

4. Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

V. INTERNATIONAL DATA TRANSFERS

By accepting this Privacy Policy, Users understand and agree that your data may be collected, stored, used in any country and/or transferred to any country in the world. Because different countries may have different data protection laws than Users’ own country, we will try to ensure that adequate safeguards are in place to protect Users’ data.

VI. SPECIAL NOTE TO INTERNATIONAL USERS

The use of the Website and Services and this Agreement is governed by and shall be construed and enforced under the laws of Singapore, without applying any conflicts of law principles that would require application of the law of any other jurisdiction. You agree to submit to the personal non-exclusive jurisdiction in Singapore and any other court of competent jurisdiction chosen by us.

In the event of any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, (a “Dispute”), we strongly encourage that a resolution first be sought through our Customer Support service.

You agree that in the event that a resolution is not obtained through our Customer Support service, such Dispute shall be referred by you and may be referred by us to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause. The Tribunal shall consist of three (3) arbitrators, with you appointing one (1) arbitrator and us appointing one (1) arbitrator and the third arbitrator to be selected by the two (2) arbitrators so appointed. The language of the arbitration shall be English.

Notwithstanding any of the foregoing, you agree that we are entitled to submit such Dispute for resolution through any other dispute resolution mechanism including the courts of any jurisdiction and we shall further be entitled to seek any injunctive or other equitable relief in the event of any breach or anticipatory breach by you, without any obligations of providing any bond or surety or proof of damages.

You irrevocably waive all rights to seek any injunctive or other equitable relief or to enjoin or restrain the operation or exploitation of the Services or any part thereof. You further irrevocably waive all rights to a class or representative action or as a named or unnamed member in a class, consolidated, representative or private attorney general action.

VII. OUR POLICIES CONCERNING CHILDREN

The Services are not intended to be accessed by persons under the age of 13, nor do we knowingly collect or solicit personal data therefrom. In the event that we learn that we have inadvertently gathered personally identifiable information from persons under the ages set out below, we will take commercially reasonable measures to ensure that such information is removed from our records.

VIII. DATA SECURITY

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you disclose on, through or within the Services and you do so entirely at your own risk. Please note that we cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice on the Website if a security breach occurs.

If you create an Account with the MingYou Platform, you will be required to select a password that can be changed at any time after you first log into the Account by using your current password. You are solely responsible for maintaining the confidentiality of your password and are fully responsible for all activities that occur under your Account and password or your account with any other third party service. Users agree to (i) notify us immediately if you are aware or reasonably suspect of any unauthorized use of your Account or password or of any unauthorized access of the Services through your Account, and (ii) ensure that you exit from your Account at the end of each session.

IX. MERGER, ACQUISITION, SALE OR INSOLVENCY

1. In the event that we are acquired by or merged with another entity, we reserve the right, in any of these circumstances, to transfer the information or assign our rights to the information that we have collected from our Users as part of such merger, acquisition, sale, or other change of control.

2. In the event of our insolvency, reorganization, receivership, winding-up or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

(a) ユーザー提供情報

i. 登録情報

お客様のアカウント登録時に、お客様はお客様個人を識別できる情報と、お客様の個人のコンテンツの好みを、直接当社に提供します。

ii. サードパーティーのサービスやモバイル機器に関するお客様情報

ソーシャルネットワーキングサイトのようなサードパーティー（第三者）のサービスや、モバイル機器を通して当社のサービスにアクセスしていただく場合は、お客様は、そのサードパーティーのサービスやモバイル機器に保存された情報を当社が入手・利用することを、間接的に許可していただくことになります。こうした情報の入手・利用は、そのサードパーティーのサービスやモバイル機器に設定されたプライバシー設定の制限を受けることがあります。サードパーティーのサービスを利用された場合は、そのサードパーティーのサービスのプライバシーポリシーの対象になります。

特に、お客様がモバイル機器を使って本サービスにアクセスされた場合は、当社がお客様のモバイル機器に、アカウント番号に似た識別子を割り当てることがあります。当社は、お客様の機器に関連する名称、機器の種類および他の技術情報、電話番号、国、連絡先、その他のご提供いただいた情報を収集する権利を有します。

iii. 課金及び財務情報

支払い手段やペイメントチャンネルを通じて課金料金をお支払いになる場合、お客様は、当社と関連する決済代行会社やサードパーティーのプラットフォームに、課金情報と財務情報を開示することがあります。決済代行会社やサードパーティーのプラットフォームをご利用になる場合には、その決済代行会社とサードパーティーのプラットフォームのプライバシーポリシーの対象となります。

iv. キャラクター情報

MY INTERACTIVEのゲームにおけるお客様のキャラクターに関連する情報（アカウントID（お客様のアカウントがMY INTERACTIVEのプラットフォームで開設されるか、お客様が当社のサービスにアクセスするサードパーティーのサービスで開設されるかには関係ありません）、プロフィール画像、キャラクターの名前など）もまた、お客様の本サービスのご利用に関連して、他のユーザーに開示される場合があります。MY INTERACTIVEのゲーム内のお客様のキャラクターに関連する情報も、お客様とつながったプレイヤーに公開されたり、サードパーティーのサービス上で公開されたりすることがあります。

v. その他

その他の追加情報をいただくことが必要となることがあり、その場合当社は、その都度お客様から具体的な許可をいただきます。

(b) Cookie（クッキー）、ログファイル、クリアGIF、Webビーコンその他のトラッキング技術

お客様が当社のウェブサイトにアクセスしたとき、当社のサービスをご利用になったときに、当社はお客様のブラウザーをユニークに特定する1つまたは複数のCookie（小型のテキストファイル）を送ります。当社は、Cookieを使用することで、お客様の好みをよりよく理解し、次回のご訪問時にお客様用のコンテンツや情報を提供することで、お客様の当社のサービスでの体験を最大限活用します。当社のCookieは、ログイン情報を保存するために利用され、ブラウザーの全てのインスタンスが閉じられると期限切れになります。当社のサービスの中には、Cookieを無効にすると適切に機能しないものがあります。

Webビーコンとして知られ、またはシングルピクセルGIFとも呼ばれるエレクトロニック・イメージが、当社のサービスの中に収められており、これにより当社はそのページを訪問したユーザー数や、他の関連する統計値（たとえば特定のコンテンツの人気度の記録やシステムやサーバーの整合性の検証）を得ることができます。Webビーコンは当社のサービスを通してお客様の個人情報を取得するためには使われず、当社のサービスのご利用に関する様々な統計値を収集するためだけに使用されます。Webビーコンは、Cookie番号、ページビューの日時、及びWebビーコンが埋め込まれたページのディスクリプションなどの限られた情報のみを収集します。

アクセス時に、当社はJavaScript（ジャバスクリプト）のようなソフトウエアツールを使い、ページの応答時間、ダウンロードエラー、特定のページの滞在時間、インタラクション情報（スクロール、クリック、マスオーバーなど）やページを離れる際に用いた方法といったセッション情報を測定し収集することがあります。

3. 収集した情報の利用

(a) お客様が（特にアカウント設定のための登録フォームへの記入や、サードパーティーのサービスにあるお客様のアカウントを通しての当社のサービスへのアクセスにより）当社に個人識別情報を提出していただいた場合は、お客様は当社のサービスの運営、維持、改善や広告に関連して、お客様の個人情報を当社が利用することに同意することになり、それにより当社は、お客様のニーズに最も関連性の高い当社のサービスを特定することができます。シンガポール以外の当社がサードパーティーの代理店パートナーと協力している国々のユーザーに関しては、現地向けのカスタマーサービスを提供するために、お客様の情報を当社の代理店パートナーと共有することがあります。

(b) 当社のサービスについて、当社のサービス内で、または当社のサービスを通して、お客様が他のユーザーとやり取りをしたり共有したりした情報は全て公表され、他者に収集され利用されます。お客様が提出または開示した情報はすべて、インターネットや他のメディアチャネルを通して再配布され、一般の人々に閲覧される場合があります。

(c) 当社は、当社のサービスの質、利用法およびデザインを改善し、当社のサービスの運営、維持、改善や広告のためにユーザーの好みや傾向を保存しトラッキングし分析して新たな機能、新たな販売促進および新たな機能性を創出し、これらを役立たせこれらを促進するために、個人識別情報と特定の個人非識別情報（匿名のユーザー利用データ、Cookie、IPアドレス、ブラウザータイプ、クリックストリームデータ、トランザクション履歴など）の両方を利用します。

(d) 当社のサービスのために、または当社のサービスに関連して、当社もしくは他のユーザーに情報を開示することにより、お客様は、当社のサービスにおいてまたは当社のサービスを通して、お客様が指定したユーザーに対して当社が情報のやり取りをすることと、当社のサービスの運営や維持や利用に関連して当社が維持する全てデータベースの情報やそのデータベースからの情報を、当社が保存し、保持し、検索することを、承諾します。

(e) 当社はCookie、クリアGIF、ログファイル情報、Webビーコン及びその他のソフトウェアを、以下の目的のために使用します。

お客様が本サービスに次回アクセスする時に再入力の必要がないように、情報を記憶すること。

（他のユーザーとのつながりを特定・示唆したり、リーダーボードおよび業績ボードの作成をするような）個人向けにカスタマイズしたコンテンツと情報を提供すること。

広告を管理し、より効率的に宣伝を行うこと。

集約メトリック（総訪問者数、閲覧されたページ数、当社のサービスの利用回数）をモニタリングすること。

ユーザー間のインタラクションをモニタリングすること。そして

上記の他に、本サービスの運営・維持・改善や、当社のサービスの広告のプロモーションやサポートすること。

ほとんどのウェブブラウザーは自動的にCookieを受け入れますが、任意に、お客様はブラウザーの設定をCookie拒否するように変更することも通常は可能です。お客様が、ご自身のコンピューターにCookieを受け入れる設定をされている場合は、当社のサービスにアクセスされる際に、お客様のアカウントの自動ログインを行う選択もできます。Cookieを拒否する選択をされた場合は、当社のサービスの一部にアクセスできなくなり、Cookieが無効になったサービスから最新情報を受け取る際に技術的問題が発生することがあります。

4. 収集した情報の開示

(a) 当社の正当な事業目的のために、当社は、個人識別情報と個人非識別情報を、当社の関連会社や系列会社に提供する場合があります。また当社は、個人識別情報と非個人非識別情報の処理のために、または、当社がマーケティング活動を含む何らかのサービスを実施するにあたって、当社の協力企業として、他の企業や人に個人識別情報と非個人非識別情報を提供する場合があります。当社は、これらの当事者（企業や人）に対して、本プライバシーポリシーに従って情報を処理することに同意することを義務づけており、これらの当事者の情報の利用を制限するために、そして、他の適切な守秘義務及び安全対策を取るために、合理的な努力を払います。

(c) 利害関係のあるサードパーティーが、当社のウェブサイト上のコンテンツ、当社のサービス、広告、プロモーションや機能の使用形態を理解するのを助けるため、当社は個人非識別情報をそのサードパーティーと共有する場合があります。

(e) 当社は、サービス利用規約を履行するために、債務に対して予防措置を取るために、第三者請求や第三者による主張を調査しこれを防御するために、政府当局と施行当局に力を貸すために、当社のサービスのセキュリティーと整合性を守るために、そして、当社、当社のユーザーその他の者の権利、財産、身の安全を守るために、妥当もしくは必要であると当社が当社の誠実な信念において信じる場合は、個人識別情報や個人非識別情報を開示する権利を有します。

(f) 他のユーザーから個人識別情報を含む情報を受け取ったユーザーは、そのユーザーから明示的に許可を得た場合や情報が機密性を失った場合を除いて、情報を開示することも利用することもできないものとします。いずれにしてもいずれかのコンテンツのユーザーやその他の者が、正式な許可を得ず開示した場合は、当社はその責任を負いません。

5. 通信設備

(a)　当社は、当社が提供する通信設備のセキュリティーは保証することはできません。当社は、当社のサービスを通して情報を開示する時は、ユーザー全員が注意を払うことをお勧めします。特に、当社のサービスに接続してお客様がユーザーとやり取りをしたり開示したりする個人識別情報や取扱いに注意すべき個人情報は、他人に収集され使われる可能性があることに、ご注意ください。

(b) 当社はユーザー間のインタラクションと当社のサービスの利用をモニタリングするために、通信を記録しアーカイブに保管する場合があります。

(c) お客様が、当社のサービスに投稿されたハイパーリンクや当社のサービス内に貼ってあるハイパーリンクを経由して選んだウェブサイトや他のサードパーティーのサービスの、プライバシーポリシーをよくお読みいただき、そのサードパーティーがお客様の情報をどのように収集し、利用し、共有するかについてご理解いただくことをお勧めします。当社のサービスを通してアクセスしたかそうでないかに関係なく、サードパーティーのプライバシーポリシーに対して、当社は責任を負いません。

6. 情報へのユーザーのアクセスと管理

(a) お客様に関して当社が収集し処理する情報の中には、お客様が入手・利用が可能なものがあります。たとえば、お客様は、ご自身のアカウントで登録された情報（氏名、Eメール、パスワード、希望される連絡方法等）、Eメール通知の設定およびトランザクション履歴にアクセスすることができます。

(b)　お客様は、当社や他のユーザーに対し情報を提供しない権利を有します。ただしお客様は、当社のサービスの利用やユーザーインタラクション（他のユーザーとのトレードへの参加など）のしやすさに、影響が出る場合があることを理解しています。

(c)　お客様は、当社のサービス、当社のウェブサイト、ソフトウェア、そして当社または当社の代理が将来提供する可能性のある何らかのサービスやソフトウェアに関連する目的のために、当社が電子メールや同様の技術経由でお客様とやり取りを行えることに同意します。

(d)　当社は、当社のサービスに関連して、ウェブサイトの中断、新機能、当社のサービスに関するのニュースについて、Eメールを配信することがあります。Eメールにはインゲームアクティビティに関する通知等が含まれています。これらのＥメールはアカウント保有者全員に送られ、登録制ではありません。このようなＥメールはユーザーに対する当社のサービスの一環であると考えています。したがってお客様のメールアドレスの変更があった場合は、必ず当社に最新情報をお知らせください。MY INTERACTIVEのプラットフォームでお客様のアカウントにアクセスして、お客様のアカウント設定ページの通知EメールアドレスをMY INTERACTIVEプラットフォームで更新していただくか、service@mingyhd.comからご依頼を提出していただくことで、メールアドレスは変更されます。

(e)　希望される連絡方法に関しては、お受け取りいただいたニュースレターに記載されている指示に従い、購読を中止したり、希望されるＥメールの連絡方法のご希望に関するお客様のアカウント設定を変更することができます。お客様のEメールアドレスが変更になり、引き続きニュースレターをお受け取りになりたい場合は、お客様がご自身のアカウントにアクセスいただいた後に、MY INTERACTIVEのプラットフォームでお客様のアカウント設定のEメールアドレスを更新した後か、service@mingyhd.comからお客様のＥメールアドレスの更新のご依頼を提出いただいた後で、再度ニュースレターにお申し込みをいただくことが必要です。

(f) 本サービスのうち限定的な部分については、匿名でのアクセスやCookieを使用せずにアクセスすることが可能です。匿名でアクセスができるコンテンツについては、当社のウェブサイトをご覧ください。

(g) 他のユーザーの情報へのアクセスができる場合は、お客様は、営利目的の勧誘で、情報を収集や採取をしたり、当社のサービスの通信設備や当社のサービスのいかなる部分も利用したりしてはならないものとします。

(h) 本プライバシーポリシーで定めている情報の収集、利用、および開示に関してお客様が同意いただけない場合は、お客様のアカウントやお客様のアカウントを通じた当社のサービスへのアクセスの解除のために、service@mingyhd.comにご依頼をご提出ください。ただし、上記手続きにより、他のユーザーに開示した情報が削除されるわけではなく、また、お客様のアカウントの削除後やお客様が当社のサービスへのアクセスを停止した後も、お客様の情報の中には、アーカイブされた当社の記録に残る可能性があるものがあることに、ご注意ください。

7. サードパーティーの広告主

(a) 当社は、当社のサービスに関して、または当社のサービスの中で、サードパーティーのアドサーバーやアドネットワークが広告を出すことを、許可することがあります。サードパーティーのアドサーバーやアドネットワークは、お客様のブラウザーに直接、本サービスについての広告やリンクや、本サービス内で現れる広告やリンクを送る技術を利用していることがあります。このようなアドサーバーやアドネットワークは、これにより広告の効果を測定し、お客様がご覧になる広告コンテンツを個人向けに変更するために、CookieやクリアGIFS等 を経由して、情報を収集することがあります。

(b)　サードパーティーのアドサーバーやアドネットワークのプライバシーポリシーを常にお読みいただき、これらが行っていることや、これらが行っていることの一部を拒否する方法をご確認ください。

(c)　他の広告主、ウェブサイト、他のサードパーティーの活動に関して、当社のプライバシーポリシーは、適用されず、当社は上記の活動の管理はできません。

8. データのセキュリティー

(a)　当社は、お客様の個人情報の完全性とセキュリティーを保つために、商業的に合理的な物理的、管理的、技術的な保護手段を講じています。しかし、当社は、当社のサービスにおいてお客様が開示した情報、当社のサービスを通してお客様が開示した情報、そして当社のサービス内部でお客様が開示した情報のセキュリティーを、確保したり保証したりすることはできず、お客様は、お客様の完全な自己責任において、このようなセキュリティーの確保と保証を行います。物理的、技術的または管理上の保護手段への侵害により、こうした情報がアクセスされず、開示されず、変更されず、破壊されることはないとの保証を、当社ができないことにご注意ください。

(b) セキュリティーシステム侵害を察知した場合、当社は、お客様が適切な防御手段をとれるように、電子媒体経由での通知を試みます。セキュリティー侵害が起きた場合、当社のウェブサイト上に通知を投稿することがあります。

(c) お客様がMY INTERACTIVEのプラットフォームでアカウントを作成される場合、最初にお客様の現在のパスワードを使ってアカウントにログインしていただいた後でパスワードを選択する必要があり、このパスワードはいつでも変更が可能です。パスワードの機密性の維持については、お客様が全ての責任を持ち、お客様のアカウントとパスワードで、または他のサードパーティーのサービスのお客様のアカウントで、発生した全ての活動に対しては、お客様が全責任を負います。お客様は (i) ご自身のアカウントやパスワードが不正に利用されていることに気づいたとき、または不正利用があったとの合理的な疑いをもった場合は、直ちに当社に通知すること、そして、(ii) セッションの終わりにはその都度、お客様のアカウントから確実に抜けること、に同意します。

9. 子供に関する方針

アカウントを開設できるのは、18歳以上の方です。加えて、MY INTERACTIVEのゲームは、13歳未満の方のご利用を想定したものではありません。当社が13歳未満の方から意図的に個人識別情報を収集することはありません。当社が13歳未満の人から不注意で個人情報を収集したことに気づいた場合は、その情報が確実に当社の記録から削除されるよう、当社は商業的に合理的な措置を講じるものとします。

10. 海外ユーザーへの特記事項

当社のウェブサイトはシンガポール共和国にホスティングされており、当社のウェブサイトと当社のサービスのご利用と本契約は、他の裁判地の法律の適用を必要とする法の抵触の原則を適用することなく、シンガポール法に準拠し、同法に従って解釈され、同法に基づき実施されます。お客様は、シンガポールの、そして、当社が選択した、管轄裁判所の非専属的な管轄権に付託することに同意します。

本契約の存在、有効性、解除等を含めて、本契約から論争が生じた場合または本件に関連する論争（「論争」）が生じた場合、当社は、先ずはカスタマーサポートサービスを通じて解決を求められることを、強くお勧めします。

解決方法がカスタマーサポートサービスを通じては得られなかった場合、お客様は、この論争をお客様がシンガポールの仲裁に付託するものすること、この論争を当社がシンガポールの仲裁に付託することができること、この論争がその時に有効であるシンガポール国際仲裁センターの仲裁規則（SIAC規則）に従って最終的に解決されるものとすること、そして、このSIAC規則が本条に言及することにより組み込まれることに、同意します。仲裁廷は3名の仲裁人で構成され、お客様が仲裁人1名を、当社が仲裁人1名を指名し、このように選ばれた仲裁人2名が、3人目の仲裁人を任命します。仲裁の言語は英語とします。

上記のいずれにもかかわらず、お客様は、当社がこの論争を他の裁判地の裁判所を含む他の紛争解決メカニズムを通じて解決するために、かかる紛争解決メカニズムに付託する権利を有していること、そしてさらに当社が、お客様による違反や期限前の違反が生じた場合には、補償金、担保、損害証明の提供義務を伴わずに、差し止め救済その他の衡平法上の救済を求める権利があることに、同意します。

お客様は、差し止め救済その他の衡平法 上の救済を求めたり、本サービスや本サービスの一部の運営や開発を差し止めたり制限したりする権利のすべてを、取り消し不能で放棄します。さらにお客様は、集団訴訟/クラスアクションや代表訴訟の権利、代表訴訟、併合訴訟または司法長官による州民代表訴訟において名前を連ねる構成員や名前を連ねていない構成員としての権利のすべてを、取り消し不能で放棄します。

11. 合併、買収、売却または債務超過

(a) 当社が他の企業に買収された場合または合併された場合、当社は、これらの状況のいずれにおいても、こうした合併、買収、売却または支配権の変更の一部として、当社がユーザーから収集した情報を譲渡する権利、または、当社のこれらの情報に対する権利を移転する権利を有します。

(b) 支払不能、会社更生、管財人による管理、清算もしくは債権者のための譲渡、または債権者の権利に影響を及ぼすコモンロー上のもしくは衡平法上の原則の適用が生じた場合、当社がお客様の個人情報の取り扱い方法、譲渡方法、利用方法を管理できない場合があります。

12. 本プライバシーポリシーの変更と改訂

(a) 本プライバシーポリシーは定期的に見直され、改定され、修正されます。変更があった場合に備えて、本ページを定期的にご覧ください。お客様が当社のサービスにアクセスすることは、（随時修正され、改訂される）このプライバシーポリシーを承認し、同意したことを示すことになります。

(b) 当社のプライバシーポリシーに関するご質問は、service@mingyhd.comからお送りください。お客様が当社にご登録いただいたアカウントに関して提供されたお客様の個人情報、または、お客様のサードパーティーのサービスのアカウントを経由した本サービスへのアクセスに基づいて提供されたお客様の個人情報を、変更、修正、更新されたい場合は、service@mingyhd.comからご依頼をお送りください。

当社がいずれかの時点で、本プライバシーポリシーの英語版の翻訳をお客様に提供した場合は、その翻訳はお客様に情報を与えるためだけに提供されたものであり、この英語版を修正するものではないことに、お客様は同意します。本プライバシーポリシーの翻訳版と英語版の間に矛盾が生じた場合は、英語版が優先されるものとします。
